RCMP in court to prevent Braidwood Inquiry finding misconduct
Author: Jesse LobdellThe four RCMP officers involved in the in-custody death of Robert Dziekanski are in BC Supreme Court in order to prevent Commissioner Braidwood from potentially making findings of professional misconduct. Commissioner Braidwood has advised each of the officers of the allegations on which he will make a determination. For example, Gerry Rundel has been advised that the following will be assessed:
- When he arrived at Vancouver’s airport, whether Rundel failed to properly assess the situation and failed to react appropriately in confronting Dziekanski;
- Whether the notes in his police notebook and the statements he gave to homicide investigators misrepresented Dziekanski’s behaviour and what happened in an effort to justify the officers’ actions;
- Whether Rundel continued to misrepresent what happened when he testified at the inquiry; and,
- Whether, during his testimony, he offered “a self-serving and misleading” interpretation of his notes and statements.

This situation could be changed readily if the Campbell and Harper Governments cared to do so. Of course, if they had moral courage, they would alter the systems of police management and police complaints.
We need apolitical police and security services answerable to officers of Parliament akin to Auditors General. No more Deputy Minister as the RCMP head. I favor a system that would impose a separate Police Complaints Commissioner, also answering to Parliament, totally separated from police agencies. It must be staffed by permanent career investigators, not people seconded from the organization they will investigate.
The Dziekanski incident will be a case study in criminology and business management for decades to come. Firstly, it exposes the undeniable corruption of organizational self-investigation. Secondly, it demonstrates how not to manage a crisis of public confidence. RCMP Brass made strategic PR errors at every turn. They even failed to understand the simple principle stated by Will Rogers, “When you find yourself in a hole, stop digging.” Ten year old children can comprehend the meaning of that old saw.

It’s not just Campbell and Harper. The public ought to exert pressure on all MLAs and MPs for these types of changes.
